1. Introduction

These Terms and Conditions govern the use of the Zoldu website and the purchase of our personalized digital products.
By using the website or placing an order, you confirm your agreement with these Terms.

If any written agreements conflict with these Terms, such agreements shall prevail.

2. Acceptance of Terms

By placing an order, uploading photos, or using our services, you confirm that you have read, understood, and accepted these Terms and Conditions, as well as our:


3. Electronic Communication

All communication between Zoldu and the customer is carried out electronically (email or website messages).
The customer is responsible for providing an accurate email address and ensuring the ability to receive messages from Zoldu.


4. Personalized Digital Products

Zoldu creates custom digital illustrations based on uploaded photos and selected themes.

  • Each product is unique.

  • Minor artistic variations (lighting, proportions, colors, facial expression) are normal and are not considered defects.

  • The final file is a creative interpretation, not an exact copy of the original photo.


5. Intellectual Property and License

All illustrations and digital files created by Zoldu are our intellectual property.

The customer receives a personal, non-transferable, non-exclusive license to use the final file for personal purposes only:

  • home decoration

  • personal gifts

  • private printing

The following actions are prohibited without written permission:

  • commercial use

  • advertising and promotion

  • resale or distribution

  • modifying the files

  • using the artwork in paid or monetized content

The watermarked preview may not be published or distributed.

Unauthorized use is strictly prohibited.

6. Customer Responsibility

By uploading photos, the customer confirms that:

  • they have the legal rights to use the images;

  • they are the parent or legal guardian when uploading a child’s photo;

  • the materials do not violate the rights of third parties.

Zoldu is not responsible for consequences arising from the customer’s improper use of uploaded images.


7. Order Process and Payment

The process includes:

  1. Uploading photos and details

  2. Paying the non-refundable deposit

  3. Receiving the preview

  4. Approving the preview

  5. Final payment

  6. Receiving the high-resolution final file

8. Refunds and Order Cancellation (UPDATED VERSION)

Our products are personalized digital items.

European Union (Directive 2011/83/EU)

The right of withdrawal does not apply to goods created according to individual specifications.

United States (UCC + FTC)

According to the Uniform Commercial Code (UCC) and FTC Consumer Protection principles, personalized digital goods are considered custom-made goods and are not eligible for refunds, except in cases of technical defects or mismatch with the approved preview.

Refund conditions

  • Refunds are possible only in case of a technical defect or if the final file does not match the approved preview.

  • By approving the preview, the customer waives the right to cancel the order.

  • After the final file is delivered, a refund is not possible.

9. Photo Upload and Data Protection

Handling of files is regulated by the Privacy Policy.

Key points:

  • files are stored for no longer than 30 days

  • after 30 days they are automatically and permanently deleted

  • deleted files cannot be restored

  • a new upload is required for a new order

10. Third-Party Services

We may use third-party services such as:

  • Stripe

  • PayPal

  • hosting providers

  • analytics tools (Google Analytics, Meta Pixel)

For payment-related data handling, refer to:

Zoldu is not responsible for the content or privacy practices of third-party providers.


11. Prohibited Use

The customer is prohibited from:

  • misusing the website

  • uploading harmful files

  • interfering with the website’s operation

  • attempting unauthorized access

Violations may result in order cancellation or restricted access.


12. Termination of Service (ENHANCED VERSION)

We may immediately suspend or terminate the provision of services if:

  • these Terms are violated;

  • fraudulent activity is suspected;

  • abusive or aggressive behavior is directed at our team;

  • chargebacks are initiated without an attempt to resolve the issue directly;

  • uploaded content violates rights or is illegal.

Termination may occur without prior notice if necessary to protect legal interests.


13. Indemnification (UPDATED VERSION)

The customer understands and agrees that:

  • Zoldu is not responsible for legal issues related to materials uploaded by the customer;

  • if a third party claims a rights violation, the customer is responsible for resolving the issue;

  • the customer compensates Zoldu for any losses, expenses, or legal costs related to:

    • violation of these Terms

    • improper use of the service

    • uploading materials that infringe intellectual property or other rights

This clause ensures lawful and fair use of the service.


14. Assignment

Rights under these Terms may not be transferred without written consent from Zoldu.


15. Entire Agreement

This agreement must be interpreted together with:

We may update these Terms periodically.
The updated version becomes effective immediately upon publication.


17. Force Majeure

We are not responsible for delays caused by circumstances beyond our control (technical issues, outages, emergencies, etc.).


18. Warranties and Liability

The service is provided “as is.”
Maximum liability is limited to the amount actually paid for the product.


19. Governing Law (UPDATED)

These Terms are governed by the laws of Estonia,
while the mandatory consumer protection rules of the customer’s country of residence also apply.
